Farming Partnerships

There are a number of different trading structures which can be used by farms and we are able to advise on the practical and fiscal implications of these. In all cases we will ensure that proper consideration is given to how the adoption of a particular structure will impinge on existing arrangements such as family tenancies, wills and future provision for dependants

We would also include such arrangements as will ensure a balance between those members of a family who are engaged in farming and others who may depend on an income or an interest in the land.

In relation to the formation of a farming company, we can act in the purchase of a shelf company and deal with the various subsequent alterations required to it to meet the client’s particular needs. We are also able to advise on the arrangements necessary for setting up joint venture labour and machinery companies. Similar assistance can be given in relation to partnerships and contracting arrangements and in all cases we can be involved in their ongoing operation.

We are particularly aware of the ongoing practical and fiscal advantages of continuing to trade as a farmer rather than taking rent as a landlord. We have precedent agreements which enable us rapidly to tailor contractual obligations to the farmer’s requirements. This will include careful consideration of termination provisions and the restriction of rights of access and user to ensure that any occupational rights similar to those in a lease are not granted inadvertently. We can also advise on the legal requirements of machinery sharing.
