Agricultural Tenancies
Acting for both landlords and tenants, we are attuned to the challenges and opportunities created by farm business tenancies where the tenant will no longer have continuing security of tenure
We are conscious of the comparative advantages of the taxation consequences of using these tenancies or alternative arrangements such as share farming or contract farming. There are many differences from a practical and taxation point of view.
In relation to tenancies created under the Agricultural Holdings legislation, we can advise in relation to their surrender where negotiation takes place.
We have experience in advising landlords in opposing applications for succession and tenants on how to plan their affairs to achieve succession. Landlords may be prepared to allow early succession to an existing tenancy, for example, so as to reorganise their landholding by releasing other tenanted property for sale. We liaise with other advisers to consider the tax effects and the benefits to the landlord. We will also deal with the production of the appropriate documentation. |
